This was Dreamworks\u2019 first animated movie, and they were entering a powerhouse genre, going head-to-head against heavy-hitters Disney and Pixar. <em>Antz <\/em>was a huge success, making millions for Dreamworks.<\/p>\n<p>Then, on November 25<sup>th<\/sup>, only a little over a month later, Pixar\u2019s <em>A Bug\u2019s Life <\/em>was released.<\/p>\n<p>There was no question someone had copied someone else. The only question was: who had copied whom?<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-full wp-image-2825 aligncenter\" src=\"https:\/\/theresarogers.art\/wp-content\/uploads\/2013\/05\/two-ppl-pointing-fingers-at-each-other-300x199-1.jpg\" alt=\"\" width=\"300\" height=\"199\" srcset=\"https:\/\/theresarogers.art\/wp-content\/uploads\/2013\/05\/two-ppl-pointing-fingers-at-each-other-300x199-1.jpg 300w, https:\/\/theresarogers.art\/wp-content\/uploads\/2013\/05\/two-ppl-pointing-fingers-at-each-other-300x199-1-150x100.jpg 150w\" sizes=\"auto, (max-width: 300px) 100vw, 300px\" \/><\/p>\n<p style=\"text-align: center;\"><em>At least this time, there&#8217;s an answer&#8230;<\/em><\/p>\n<p>Turns out, John Lasseter, who was friends with Jeffery Katzenberg at the time, had told Katzenberg all about <em>Bug\u2019s Life <\/em>on a visit to L.A. in the fall of 1995. In his battle to undercut Disney, which distributes Pixar films (and now owns them), Katzenberg began production on <em>Antz<\/em>, intentionally planning on getting it into theaters before <em>Bug\u2019s Life.<a title=\"\" href=\"#_ftn1\"><strong>[1]<\/strong><\/a><\/em><\/p>\n<p>That sure as heck was copying. But was it also plagiarism? And why am I making that distinction?<\/p>\n<p>Because it appears that while plagiarism is illegal, copying isn\u2019t. The law states that no one can legally protect an idea\u2014only the implementation of an idea. If we apply that law here, then the idea \u201can ant with individual ideas uses them to save his colony\u201d isn\u2019t protected. And the way that idea is implemented in <em>Antz <\/em>and <em>Bug\u2019s Life <\/em>is, indeed, different, so there is no legal problem, and, therefore, no plagiarism.<\/p>\n<p>But the issue at hand is much bigger than this simplistic distinction implies. Legal or not, there is the whiff (and perhaps more than that, a downright stink) of the dishonest in what Dreamworks did. Individual implementation aside, there\u2019s no way to see the two movies without knowing, in our bones, that, indeed, \u201csomeone copied someone else.\u201d We sense the moral wrongness of what Katzenberg did, regardless of whether it is legally allowed.<\/p>\n<p>In the writerly world, consider <em>50 Shades of Grey<\/em>. This book originated as <em>Twilight<\/em> fanfic. Indeed, the main characters still retain the exact physical and emotional characteristics of Meyers\u2019s, with the exception that the male protagonist is no longer a vampire. It\u2019s impossible to read the two books without noting the blatant similarities\u2014even, overall, in aspects of their plot arcs.<a title=\"\" href=\"#_ftn2\">[2]<\/a><\/p>\n<p>Fanfic has a long history of drawing its inspiration from existing, copywrited works, and I\u2019m not knocking it in the least. But when it goes on to its own publishing life, something goes creepy-crawly up my spine because of that copywrite on the source material. Again, this doesn\u2019t fit the legal definition of plagiarism. But there\u2019s no denying that something ain\u2019t right there, and the literary world agreed, diving into the ethical considerations of publishing <em>50 Shades.<a title=\"\" href=\"#_ftn3\"><strong>[3]<\/strong><\/a><\/em><\/p>\n<p>But it gets more distressing, and confusing. Because in thinking about the roots of fanfic, I realized the real question in these cases is about much more than copying.<\/p>\n<p>Which brings us to the case we discussed at a writers meeting I attended, where author Kelly Rucker brought a suit against Harlequin, alleging that they stole her idea for a novel. I\u2019m not so interested in the outcome of this case, or even the actual particulars, but instead, in the implications. Because the real question raised by all these examples is: what is the role of inspiration in the creative life? And when I realized that was the actual question, I got nervous about my reactions to both <em>Antz <\/em>and <em>50 Shades.<\/em><\/p>\n<p>In the case of <em>Kelly Rucker vs. Harlequin Enterprises, Ltd. <\/em>the real accusation is about the source of the <em>inspiration<\/em> for the Harlequin book. Did Rucker\u2019s book, <em>How to Love a Billionaire, <\/em>inspire <em>The Proud Wife? <\/em>In that case, does phrasing the question as \u201cDid <em>A Bug\u2019s Life <\/em>inspire <em>Antz?\u201d <\/em>change our feeling about the issue of those movies?<\/p>\n<p>I am a devotee of inspiration. I would wield a sword against the strongest opponent to protect our right to be inspired by others\u2019 ideas. But is inspiration a different animal than plagiarism? Or does the very idea of inspiration contain within it the notion of plagiarism?<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"size-medium wp-image-2827 aligncenter\" src=\"https:\/\/theresarogers.art\/wp-content\/uploads\/2013\/05\/2_DD_Plagiarism_03_posterprint-225x300.jpg\" alt=\"\" width=\"225\" height=\"300\" srcset=\"https:\/\/theresarogers.art\/wp-content\/uploads\/2013\/05\/2_DD_Plagiarism_03_posterprint-225x300.jpg 225w, https:\/\/theresarogers.art\/wp-content\/uploads\/2013\/05\/2_DD_Plagiarism_03_posterprint-113x150.jpg 113w, https:\/\/theresarogers.art\/wp-content\/uploads\/2013\/05\/2_DD_Plagiarism_03_posterprint.jpg 600w\" sizes=\"auto, (max-width: 225px) 100vw, 225px\" \/><\/p>\n<p style=\"text-align: center;\"><em>Do we feel better if we call it a tribute? But this is a<\/em><\/p>\n<p style=\"text-align: center;\"><em>very interesting point of view from designers.<\/em><\/p>\n<p>What are the rules? Do we want there to be rules? If we do, how strict do we want them to be?<\/p>\n<p>The law as written and put into practice falls clearly on the side of those who wish to copy\u2014who wish, in what to me feels like the true spirit of the word, to plagiarize\u2014because of the inherent looseness of the idea of \u201cimplementation.\u201d Are we happy with the distinction between \u201cidea\u201d and \u201cimplementation\u201d if it allows instances like <em>Antz<\/em>\/<em>Bug\u2019s Life<\/em> and <em>Twilight\/50 Shades <\/em>to happen?<\/p>\n<p>On the other hand, if we eliminate that distinction, if we win cases against the <em>Antz <\/em>and <em>50 Shades <\/em>and <em>Good Wife<\/em>s of the world, have we now hamstrung ourselves from being able to be \u201cinspired\u201d at all?<\/p>\n<p>I don\u2019t know the answers. I\u2019ve had amazing and valuable conversations with a variety of people about this, some who believe there\u2019s a real problem and some who don\u2019t. \u00a0There isn\u2019t a clear resolution.
